These Terms of Purchase (“Terms of Purchase”) govern your purchases of products and services available through Vapepie EU (the “Company Sites” or the “Sites”). Your use of the Company Sites and these terms are also governed by the Terms of Use and Privacy Notice (EU GDPR-compliant), which are incorporated herein by reference.

PLEASE CAREFULLY READ THESE TERMS OF PURCHASE, ALONG WITH THE TERMS OF USE, PRIVACY NOTICE, AND OTHER POLICIES REFERENCED HEREIN, BEFORE PURCHASING OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY SITES.

BY PURCHASING OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY SITES, YOU AGREE TO THESE TERMS OF PURCHASE, INCLUDING WITHOUT LIMITATION, THE DISPUTE RESOLUTION AND CLASS ACTION WAIVER DESCRIBED IN THE SECTION BELOW.

GENERAL

These Terms of Purchase constitute a valid and binding agreement between you and Vapepie EU (the “Company”), enforceable against you in accordance with their terms.

You represent and warrant that you are:

At least 18 years of age (or the legal age to purchase vape products in your jurisdiction, whichever is higher);
Of legal age to form a binding contract under the laws of your country/region;
Not barred from receiving products or services under any applicable laws, rules, or regulations (including EU tobacco/vape directives).

You shall purchase and use products/services available through the Company Sites in strict compliance with these Terms of Purchase and all applicable laws, rules, and regulations (collectively, “Laws”). You are solely responsible for complying with all Laws in the jurisdiction to which products are shipped (e.g., EU TPD, German Nicotine Ordinance).

All communications between you and the Company (calls, emails, chats) may be recorded for quality assurance and dispute resolution purposes.

PRIVACY NOTICE

The Company’s GDPR-compliant Privacy Notice—governing the collection, use, disclosure, and processing of your personal information—is available at www.24vape-pie.com/privacy (or via the footer of our EU website).

By using the Company Sites or providing personal information to us, you consent to such information being collected, stored, and processed in accordance with the Privacy Notice. The Company may update its Privacy Notice from time to time at its sole discretion; changes will be posted on our EU website. Your continued use of the Sites after any updates constitutes acceptance of the revised Privacy Notice.

PURCHASES

Order Processing

The Company reserves the right, in its sole discretion, to:

Decline or cancel your order (e.g., if a product is out of stock, mispriced, or suspected of fraud);
Verify your identity (via email, ID, or payment method) to process your order.

If we cancel or do not process your order, we will either:

Not charge your payment method, or
Refund any amounts charged (within 5 business days for EU orders).

Without limiting the foregoing, the Company may:

Revoke any promotional offer;
Correct errors, inaccuracies, or omissions in product descriptions, pricing, or promotions;
Update prices, content, or product specifications without prior notice (including after an order is submitted, acknowledged, or shipped—except as prohibited by EU consumer law).

Product and Service Descriptions

The Company strives to provide accurate descriptions of products/services on the Company Sites. However, we do not warrant that descriptions are error-free, complete, reliable, or current. If a product/service differs materially from its description, your sole remedy is to return the item in accordance with our EU Return Policy (linked below).

The Company Sites may offer a “Quick View” feature for products, allowing you to view pricing and add items to your cart without visiting the product page. This feature is for your convenience only—the product page contains critical details (e.g., nicotine strength, EU compliance certifications, safety warnings) that you must review before purchasing.

Pricing Information

The Company aims to provide accurate pricing for EU orders (all prices include 19% German VAT or your local EU VAT rate, where applicable). However, we cannot guarantee against pricing errors. If a product’s price is incorrectly posted due to an error:

We reserve the right to cancel your order;
We will notify you via email (using the address associated with your order);
We will refund any charges within 5 business days.

Product and Service Availability

Information on the Company Sites regarding product availability (e.g., “In Stock”) is for estimation purposes only. Inventory levels change frequently, and a product listed as “in stock” when you place your order may be sold out by the time we process it.

If this occurs:

We will cancel the out-of-stock item from your order;
We will notify you via email;
We will remove the item from the Company Sites.

Estimated delivery times (from our German or Netherlands warehouse) are:

Germany/France/Italy/Spain: 2–5 business days;
Nordic/Eastern Europe: 3–6 business days.

Delivery times are subject to change due to:

High demand (e.g., Black Friday sales);
Carrier delays (e.g., DHL/DPD sorting backlogs);
Incorrect or incomplete shipping addresses.

Specific Additional Disclaimers and Obligations

In addition to the general disclaimers in our Terms of Use, products/services purchased through the Company Sites:

May not include manufacturer warranties (even if the product is sold with one elsewhere);

May not have product manuals, instructions, or safety warnings in your native language (we provide English/German translations for EU orders);
May not conform to your jurisdiction’s standards (e.g., voltage, labeling)—you are solely responsible for verifying compliance before purchasing;
Are intended for use in the EU only (unless explicitly stated otherwise).

Taxes and Duties

For EU orders:

All prices include VAT (value-added tax) at the rate applicable to your country (e.g., 19% in Germany, 20% in France).
No additional import duties or customs fees will be charged (our EU warehouses handle local tax compliance).

For non-EU orders (Canada/Australia):

Taxes are included in the product price, but your local customs may levy additional duties—these are your responsibility.

GOVERNING LAW

These Terms of Purchase, and any disputes arising from or related to them, shall be governed by and construed in accordance with the laws of Germany (the location of our primary EU warehouse), without regard to its conflict of laws principles.

Any dispute between you and the Company shall be resolved exclusively in the courts of Frankfurt am Main, Germany, unless otherwise required by mandatory EU consumer protection laws.
